La Regla Del Asesino [«Slayer Rule»]

En el argumento de películas como Gran Hotel Budapest (Wes Anderson, 2014) o Puñales por la espalda (Rian Johnson, 2019), hay un momento en el que alguno de sus protagonistas se refiere al término anglosajón «Slayer rule» que, en castellano, suele traducirse mediante una apropiación directa del inglés como «Regla del asesino». Veamos algunos ejemplos normativos antes de describir su significado: en Iowa (EE.UU.), el parágrafo §633.535 de su Probate Code (capítulo 633 del Título XV del Iowa Code) dispone que: A person who intentionally and unjustifiably causes or procures the death of another shall not receive any property, benefit, or other interest by reason of the death as an heir, distributee, beneficiary, appointee, or in any other capacity whether the property, benefit, or other interest passed under any form of title registration, testamentary or nontestamentary instrument, intestacy, renunciation, or any other circumstance. The property, benefit, or other interest shall pass as if the person causing death died before the decedent.

Junto a ese estado del Medio Oeste norteamericano, otros muchos incluyen preceptos similares en sus códigos estatales en ámbitos como la legislación de seguros; así ocurre, por ejemplo, en la sección 1103.151 del Official Insurance Statutes de Texas al establecer que: A beneficiary of a life insurance policy or contract forfeits the beneficiary's interest in the policy or contract if the beneficiary is a principal or an accomplice in wilfully bringing about the death of the insured. Y lo mismo sucede en el capítulo 41B de los Nevada Revised Statutes o en el §250 del Probate Code de California.

Tanto en un caso como en otro, los legisladores estadounidenses contemplan que ni el heredero ni el beneficiario de una póliza reciban nada si han sido condenados por asesinar a los difuntos causante o tomador del seguro, respectivamente.

Para la investigadora de la Universidad de Baltimore, Tara L. Pehush, el origen de esta doctrina se remonta en el Common Law británico que, a su vez, se basó en aplicar la máxima latina de nullus commondum capere potest de injuria sua propia (ningún hombre puede aprovecharse de su propio delito). Tras la independencia, los tribunales de EE.UU. comenzaron a aplicar esta doctrina en el siglo XVIII y el Tribunal Supremo se refirió a esta regla, por primera vez, en el caso New York Mutual Life Insurance Co. v. Armstrong, de 1886 [PEHUSH, T. L. "Comments: Maryland Is Dying for a Slayer Statute: The Ineffectiveness of the Common Law Slayer Rule in Maryland". En: University of Baltimore Law Review, vol. 35, nº 2, 2005, pp. 271 a 297].
